The following Terms of Use (Terms) are the terms of a legal agreement between you and Russell Jones t/as Googley Logo Design. By accessing, browsing, or using this website, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Website Content

This website contains graphics, images, artwork, logos, icons, text and other information (Content). The layout of this website and all Content in this website is subject to copyright owned by Russell Jones or his related entities and is protected by the Copyright Act 1968 (Cth) and other international copyright laws. Brands, names, images and logos displayed on the website may be the subject of registered trade marks of Russell Jones or his related entities and protected by the Trade Marks Act 1995 (Cth) and other international trade mark laws. All rights in this website and its Content are reserved worldwide.

You may access, display, download and print portions of the website only for your own private non-commercial use, to order products or services via the website and otherwise as expressly permitted by these Terms. This permission is subject to you not modifying the content displayed on this site, keeping intact all copyright, trade mark, and other proprietary notices, and any additional restrictions or express exceptions displayed on the website. Googley Images

You acknowledge that copyright in each image displayed on the website (Googley Image) used by Russell Jones to create logo designs ordered by you (if applicable) via the website (Logo Designs) is and remains the property of Russell Jones. Upon receipt of all fees payable by you for each respective Logo Design, Russell Jones hereby grants you, your assignees and successors in title a non-exclusive, perpetual, royalty-free licence to reproduce, distribute, publish, display and use the relevant Googley Image in any medium only as part of the relevant Logo Design and only for the purpose of you, your assignees and successors in title carrying on the business represented by the Logo Design. You must ensure that your assignees and successors in title comply with these Terms.

The logo design tools provided on this website employ a limited number of elements, including images, colour schemes, and design effects. Russell Jones reserves the right to use all such elements and to make all such elements available for use by other parties in the future. You do not obtain any right or claim to any of the individual logo design elements comprising or resulting from your Logo Design and/or your incorporation of a Logo Design into one or more products. Other Russell Jones' customers may use the same Googley Images available on the website and the same design tools to create logos that have similar or identical combinations of these elements. You acknowledge and agree that your Logo Designs may be similar to or contain the same Googley Images as Logo Designs ordered and used by other parties.




Use of Website and Googley Images

Use of this website is at your sole risk. To the extent legally permitted, all materials, information, products and services are provided “as is”, with no warranties or guarantees whatsoever. Russell Jones expressly disclaims to the fullest extent permitted by law all express, implied, statutory and other warranties, guarantees or representations, including, without limitation, the warranties of merchantability and fitness for a particular purpose. Without limitation, Russell Jones provides no warranty of any kind that the website Content or Logo Designs created using the design elements on this site will not infringe, or be subject to a claim of infringing, the trademark, copyright or other intellectual property or proprietary rights of another party. It is solely your responsibility to obtain the advice of an attorney regarding whether the logo design is legally available for your use and does not infringe the rights of another party. If applicable law prohibits the exclusion of any of the warranties referred to above, to the extent legally permitted, Russell Jones limits his liability for breach of any such warranties, conditions or representations to resupply of the affected products or services or payment of the cost of resupply of the affected products or services, at his discretion.

Liability

To the extent legally permitted, in no event will Russell Jones be liable to any party for any direct, indirect, incidental, special, exemplary or consequential damages of any type whatsoever related to or arising from this website or any use of this website, or of any site or resource linked to, referenced or accessed through this website, or for the use or downloading, or access to, any materials, information, products or services, including, without limitation, any lost profits, business interruption, lost savings or loss of programs or other data, even if Russell Jones is expressly advised of the possibility of such damages. This exclusion and waiver of liability applies to all causes of action, whether based on contract, warranty, tort (including negligence) or any other legal theories. To the extent that the above exclusion of liability is unenforceable, invalid or ineffective for any reason, it will be severed from these Terms and Russell Jones’ maximum aggregate liability for all losses, damages and other amounts referred to in the above exclusion of liability under any cause of action referred to in the above exclusion of liability is limited to AUD$50.00.

Law

These Terms are governed by the law of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South
